1. Acceptance of Terms

By accessing or using FocusFlow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and FocusFlow.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service. Your continued use after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

FocusFlow is a web application that provides productivity tools based on the Pomodoro Technique. The Service includes customizable work and break timers, session tracking and statistics, habit tracking and streak monitoring, virtual study rooms with real-time synchronization, and cloud data synchronization across devices.

The Service is available in a free tier with core features and a Premium tier with additional capabilities. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts

To access certain features, you must create an account using a valid email address or third-party authentication provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must not create accounts for others without permission or use another person's account without authorization.

4. Premium Subscriptions

Premium subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge the applicable subscription fee to your payment method. Prices are displayed in USD and may vary by region.

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to Premium features until the end of your current billing period. No partial refunds are provided for unused portions of a billing cycle. We offer a 7-day money-back guarantee for new subscribers.

We reserve the right to change subscription pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle after the notice period.

5. Study Rooms

Study rooms enable real-time collaboration between users. When using study rooms, you agree to: use an appropriate and non-offensive display name; not share harmful, illegal, or inappropriate content through the room; respect other participants and maintain a productive environment; and not attempt to disrupt, overload, or abuse the real-time synchronization infrastructure.

Room hosts are responsible for the conduct within their rooms. We reserve the right to terminate rooms or suspend users who violate these guidelines without prior notice.

6. Intellectual Property

All content, features, and functionality of FocusFlow — including but not limited to text, graphics, logos, icons, design, software, and code — are the exclusive property of FocusFlow and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any personal data you input into the Service (session notes, habit descriptions, etc.). By using the Service, you grant us a limited, non-exclusive license to use this data solely for the purpose of providing the Service to you.

7. Prohibited Conduct

You agree not to: use the Service for any illegal purpose or in violation of any applicable laws; attempt to probe, scan, or test the vulnerability of the Service or breach any security measures; interfere with or disrupt the Service or servers connected to the Service; use automated means (bots, scrapers) to access the Service without our prior written permission; impersonate any person or entity or falsely claim an affiliation with any person or entity; or use study rooms to distribute spam, malware, or inappropriate content.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected.

The Pomodoro Technique is a time management methodology. FocusFlow is a tool to help implement this technique, but actual productivity results depend on individual effort, commitment, and circumstances. We make no guarantees regarding productivity improvements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUSFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: loss of profits, data, use, or goodwill; missed deadlines or appointments; interruption of business; or any other intangible losses arising from your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless FocusFlow and its affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in Brazil.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may request deletion of your account and associated data at any time by contacting us.

Sections relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination of these Terms.

13. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of FocusFlow after changes constitutes acceptance of the new Terms. If you do not agree with the revised Terms, you must discontinue use of the Service.
